By this petition the petitioner seeks protection from respondents No.2 to 5, respondent No.2 being the elder son of the petitioner and respondents No.3 to 5 being the sons of respondent No.2. 7.

Status Report has been filed by the State. As per the Status Report, apparently, there is a dispute in relation to Shop No.4 in Okhla Sabzi Mandi which was purchased in the name of the petitioner and his brother in the year 2006. Claim of respondent No.2 is that the shop was purchased from the funds of the partnership firm wherein he was also working and that he has been continuously doing business in the half portion of the said shop W.P.(CRL) 1230/2017

with the petitioner. Due to differences, the petitioner now had disinherited the respondent No.2 and his family members and therefore, complaints have been filed between the parties. A Civil Suit for permanent injunction has already been filed by the petitioner before the learned Additional Civil Judge.

As per the Status Report, the Beat and Division staff has already been sensitized to take action in case the protection of the petitioner is violated besides the concerned police station has also taken preventive action under Section 107/150 Cr.P.C. where both the parties have been bound down. Further, as per the Status Report, on verification no incident was found to have taken place as alleged by the petitioner. 9.

Considering the nature of dispute between the parties, no further orders can be passed in the present writ petition. 10.

Petition is disposed of directing the SHO concerned to provide protection to the petitioner as and when required through Beat staff. MUKTA GUPTA, J.
