CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 28.09.2018 1.

By this petition, the petitioner seeks parole to re-establish social ties and to look after his ailing mother. Petitioner also challenges the communication dated 26th July, 2018 rejecting his application for grant of parole. A status report has been handed over which is taken on record. 2.

As per the status report, the mother of the petitioner was found residing at House No.114/89, Sector-114, Pratap Nagar, Sanganer, DistrictJaipur, Rajasthan. The petitioner has three sisters who are all married. As per the nominal roll, the petitioner was granted parole twice in the year 2016 and thereafter furlough for a period of three weeks with effect from 15th February, 2017. The petitioner's conduct in jail was unsatisfactory from 31st W.P.(CRL) 2447/2018

July, 2017 to 12th September, 2017 and thus for the last one year he has neither been granted any parole nor furlough. Since from the last punishment one year has already elapsed and even though as per the nominal roll, the co-convict had jumped the parole the petitioner did not misuse the concession of parole/furlough granted to him, this Court deems it fit to grant parole to the petitioner but on stringent conditions. 3.

It is, therefore, directed that the petitioner be released on parole for a period of four weeks on his furnishing a personal bond in the sum of ₹25,000/- with two surety bonds of the like amount out of which at least one surety would be a family member of the petitioner to the satisfaction of the Trial Court further subject to the condition that the two sureties of the petitioner would keep their mobile phones in active mode through the period of parole so that if required, petitioner can be contacted. 4.

Petition is disposed of.

5.

Copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
