% 01.05.2017 Crl.M.A. 7095/2017 (Exemption) Application is allowed subject to just exceptions. Crl.M.C. 1744/2017 The present petition has been filed for quashing of FIR No.54/2011, under Sections 447/323/354/506/34 IPC, Police Station Sultan Puri.
This Court is of the considered opinion that the inherent powers of the High Court cannot be exercised to circumvent the express provisions of law.
Admittedly, Sections mentioned in the FIR in question are 447/323/354/506 IPC which are compoundable in nature. This Court is not inclined to use the inherent powers in the present case.
However, the petitioners are at liberty to approach the trial court under Section 320 Cr.P.C.
The petition is disposed of accordingly.
