O R D E R
% 24.05.2017 After hearing for some time, learned counsel for both the parties, on instructions, submits that the parties are willing to settle the matter. The matter is taken up again. The appellant as also the respondent no. 1 file their respective undertakings in terms of the settlement arrived at between them.
The appellant submits that she will vacate the suit property and handover its peaceful possession to the respondent no. 1 and 2 on or before 31.07.2017. The undertaking given by the appellant is hereby accepted. She shall remain bound by the undertaking given to the court. The respondent no. 1, for herself and on behalf of respondent no. 2, also files undertaking and submits that she will pay the gratuitous amount of Rs.25,000/- to the appellant w.e.f. August, 2017 for a period of five years
and they will deposit the same by 7th day of each month in the bank account furnished by the appellant in her affidavit-cum-undertaking. The undertaking given by the respondent is also accepted. The respondent submits that the impugned judgment and decree shall be deemed to have been satisfied by this compromise.
The undertakings given by the parties are taken on record. The parties shall bear the consequences of breach of their respective undertakings.
In view of the settlement/compromise between the parties, the appeal and all pending applications are disposed of. VINOD GOEL, J.
