The petitioner - an accomplished sportsperson in the sport of Sambo - has filed the present petition, inter alia, praying that directions be issued to respondent no.2 and/or respondent no.1 for allowing the petitioner to participate in the 18th Asian Games as a member of the Indian contingent. 3.

It is the petitioner's case that he was included in the list of sportspersons who are accredited for participating in the said Games. However, without informing the petitioner, respondent no.2 (IOA) has

deleted the name of the petitioner from the Indian contingent. 4.

Mr Phalpher, learned counsel appearing for the IOA states that the petitioner's name was dropped from the contingent on 10.07.2018 as the petitioner did not meet the requisite criteria inasmuch as he had not secured the 6th position or better at any Asian or World Level Championship. He has also drawn the attention of this Court to the results of the petitioner in various tournaments (annexed as Annexure P-1 to the petition). The same indicates that the petitioner had secured 7th position at the 5th Asian Indoor and Martial Arts Games held at Ashgabat, Turkmenistan in 2017. Prior to that, the petitioner had participated in Asian Sambo Championship held at Taskan, Uzbekistan in 2014 but had not secured any position. The petitioner had also participated in the 5th Asian Beach Games held at Danang, Vietnam in 2016. However, the said event has not been considered as comparable to an Asian Level Tournament.

In view of the above, this Court is unable to accept that any interference is warranted at this stage. Primarily, for the reason that Asian Games have already commenced and further, it also appears that the petitioner does not meet the specified criteria. 6.

The petition is, accordingly, dismissed. The pending application is also disposed of.
