% 05.09.2018 C.M.No. 35963/2018 Allowed, subject to all just exceptions.

W.P.(C) 9296/2018 & C.M.Nos.35962/2018 (stay) 1.

The petitioner is aggrieved by an order dated 10.08.2018 passed by the respondent no.2, which is stated to be in pursuance to the order dated 18.07.2018 passed by the Tribunal in O.A. 979/2018 earlier filed by her.

2.

Ms.Sahni, learned counsel for the petitioner states at the outset that the petitioner does not have any grievance against the order dated 18.07.2018 for the reason that by the said order, the Tribunal had simply left the matter open for the petitioner to submit a representation to the respondents for seeking extension of her tenure, with directions to the respondents to pass an order thereon within 15 days. She states that it is in pursuance of the aforesaid order that the W.P.(C) 9296/2018

impugned order dated 10.08.2018 has been passed by the respondent no.2.

3.

We are of the opinion that the petitioner cannot approach this Court directly as if it is the first Court to assail the impugned order. It is open for the petitioner to seek her remedy before the Tribunal against the said order in the first instance. 4.

The writ petition is dismissed as not maintainable alongwith the pending applications, with liberty granted to the petitioner to approach the Tribunal with her grievance against the impugned order dated 10.08.2018, passed by the respondent no.2.
