O R D E R

% 01.05.2017 The petitioner, who is an accused in a case under Section 364A read with Section 34 of the IPC, seeks interim bail for a period of one month for attending to his ailing mother who has to be operated upon for removal of uterus which has become cancerous.

The aforesaid fact has been verified by the State. The operation is scheduled for 02.05.2017.

Ms. Neelam Sharma, learned Additional Public Prosecutor, but, has submitted that the petitioner is the main accused in this kidnapping case and his mobile was used for making ransom calls. He has also threatened the kidnapped boy of dire consequences by wielding a dagger at him. Be that as it may, considering the fact that the mother of the petitioner is to be operated upon, this court is inclined to release the petitioner on interim bail for a period of 7 days, to be counted from the date of his release

and coinciding with the date of the operation of the mother of the petitioner. Let the petitioner be released on interim bail for 7 days, on his furnishing a bond in the sum of Rs.25,000/- with two sureties of the like amount to the satisfaction of the trial court. One of the sureties will be the sister of the petitioner. The petitioner, on his release shall not meet with any person who would be interested in his prosecution/conviction.

The petitioner shall not indulge in any unlawful activity and shall not leave the confines of National Capital Region of Delhi without intimating the SHO of the concerned police station. Should the petitioner be found violating the aforesaid conditions of interim bail, it would be open to the State to seek cancellation of his bail forthwith.

The application is allowed.

Let a copy of the order be given dasti under the signature of the Court Master.
