% 27.07.2017 Record of the suit filed by the petitioner is received. This suit stands dismissed in default on 10.8.2016 and in the plaint, there is no mention of any unauthorized construction having been raised by the respondent Ravi Verma, against whom, the suit for possession had come to be filed.

Mr. Tyagi, ld. ASC for respondent no.1 has handed over a status report.

As per the status report, the property was booked for the alleged unauthorized construction on 11.5.2017. For the unauthorized construction, demolition order is said to have been passed and executed on 24.7.2017.

As regards the misuse of the basement, sealing proceedings under Section 345A are also said to

have been initiated.

In view of the action taken by the respondents, the petition does not survive any further and is dismissed accordingly. Should the petitioner find at a later point of time that respondents are failing in discharge of its duty, liberty is reserved to the petitioner to file another petition.
