5.
Learned Additional Standing Counsel for the State accepts notice. 6.
Status report has been handed over which is taken on record. W.P.(CRL) 2462/2018
7.
As per the status report, besides the conviction and sentence of the petitioner in the present FIR under Section 307/34 IPC where he has been awarded 8 years imprisonment which was upheld in appeal by this Court, the petitioner is involved in three other cases. Further, the family of the petitioner comprises of his mother, brother and sister-in-law who can take care of his sister. Further the sister has her own children to look after her. 8.
A perusal of the nominal roll reveals that besides present FIR, the petitioner has been convicted in two other FIRs as well and is facing trial in the third under Section 324 IPC registered at PS Adarsh Nagar. The petitioner has been in custody and his conduct in jail itself is unsatisfactory. As per the nominal roll, the petitioner has been awarded punishments in every year including for getting prohibited articles, inflicting self-injury, misbehaving with the co-inmates.
9.
Considering the fact that the sister for whose treatment the petitioner seeks parole has her own children besides her mother, other brother and sister-in-law and the nominal roll reflects that the petitioner has been convicted in two other cases besides present one and facing trial in the fourth case as also the jail conduct, this Court finds no ground to grant parole to the petitioner. The petitioner can file the Special Leave Petition through legal aid available in jail.
10.
Petition is dismissed.
11.
Copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
