C.M. No.47277/2017 By way of this application, the petitioner is seeking extension of time to vacate the suit premises.

On advance notice, learned counsel for the nonapplicant/landlord has put in appearance. He has opposed this prayer. This Court notes that on 06.07.2017, a revision petition filed by the petitioner had been dismissed. This was against the order passed by the ARC under Section 14 (1)(e) of the DRCA. On 06.07.2017, a direction had been given to the petitioner to handover peaceful and vacant possession of the suit property to the landlord/respondent on or before 31.12.2017. The revision petition had been disposed of. A review petition has been filed by the petitioner. This had also

been dismissed on 19.9.2017. The review petition was found to be malafide and was accordingly dismissed.

The order dated 06.07.2017 had given sufficient time to the petitioner to explore the possibility of an alternate accommodation and the direction to vacate the premises on or before 31.12.2017 was well known to the petitioner at that point. His application, at this stage, seeking another two weeks to vacate the premises for the reason that he has preferred an SLP against the order dated 19.09.2017 does not hold any water. This Court is not inclined to grant any further extension of time.

Dismissed.
