% 08.03.2018 The petitioner is aggrieved by the order dated 08.03.2017 because his written statement which had been earlier taken on record was taken off the record because of the reason it had not been submitted within the statutory period of thirty days or even within the extended period of ninety days. It appears the petitioner had some explanation to offer, it relating to the time spent before the mediator to arrive at amicable resolution, some confusion on account of perceived deficiency in the paper book that had been supplied and the delay in engaging he counsel. Be that as it may, after some hearing the counsel for the respondent fairly conceded that she would have no objection if the written statement is taken on record though subject to suitable terms. Given the facts and circumstances, the delay is condoned.

Subject to cost of Rs.10,000/- the written statement is taken on record. Needless to add, the trial Court will proceed with the matter further from the stage where it would need to be taken up after completion of the pleadings. The petition stands disposed of in above terms. R.K.GAUBA, J.
