This application is filed under Order 23 Rule 3 CPC. With the application is also attached the agreement which is signed by the parties. The application is also supported by the affidavits of the parties. Requirements of Order 23 Rule 3 CPC are hence satisfied. This application is allowed and the suit is disposed of in terms of the present application under Order 23 Rule 3 CPC of which the Settlement Agreement dated 25.4.2018 will form a part of the decree. Decree sheet be accordingly drawn up.

Since the suit has been disposed of as compromised before framing of issues, plaintiff is held entitled to refund of the 50% of the court fees in terms of Section 16-A of the Court Fees Act, as applicable to Delhi, and Registry will issue the necessary certificate in favour of the plaintiff.
