% 25.05.2017 During the hearing, the learned counsel for the petitioner himself submitted that after filing writ petition at hand the petitioner has also filed a criminal complaint in the court of Additional Chief Metropolitan Magistrate (ACMM), West at Tis Hazari Courts, Delhi where it is presently pending, it being founded on the same set of facts and circumstances as are brought out here.
For relief in terms of the criminal action as is sought through the writ petition at hand the appropriate remedy already taken out will have to be pursued. For relief in the nature of recovery of possession of the premises of which the petitioner alleges he was deprived of, the petitioner will have to take out appropriate proceedings before the civil court of competent jurisdiction.
Petition along with accompanying application is dismissed with these observations.
