% 27.08.2018 By order dated 05.07.2018, in sessions case no. 499/2017, arising out of FIR No. 240/2017, the court of sessions has directed the charge to be framed, inter alia, against the applicant for the offence punishable under Section 307/34 of Indian Penal Code, 1860 (IPC). The background facts, as noted in the said order, are that attempt to commit murder was made by certain persons having come on two twowheeler scooters, they statedly including the applicant, to the house of the first informant Kusum and her husband Satbir having been fired at by one of them. Though, the applicant was not named in the FIR, his involvement is shown to have come up and he having been identified during the investigation by the complainant on 24.11.2017. The trial court having found sufficient grounds to frame charges on the basis of available material, it cannot be said that the allegations against the petitioner are unfounded. As material witnesses have not yet been examined, at present stage BAIL APPLN. 1988/2018

the application for bail ought not be entertained or allowed, also in view of the order dated 12.07.2018 whereby the earlier bail application (no.1243/2018) was dismissed as withdrawn.
