% 16.01.2019 Notice of CM APPL. No. 54022/2018 is indicated to have not been served on the respondent no.2. The respondent no.3 arrayed on record is apparently being a proforma party inasmuch as PF is reported to have returned under objections.

At this stage, learned counsel for the appellant is present. In terms of order dated 20.12.2018, the Trial Court Record has been received which indicates that the matter is listed before the learned Trial Court for plaintiff's evidence for the date 05.03.2019. The counter affidavit of the respondent no.1 is on the record. The only prayer made by the petitioner through the present petition and the accompanying application is that the matter be disposed of expeditiously inasmuch as the suit was instituted on 21.04.2015. The

learned Trial Court is requested to make an endeavour to dispose of the suit within 15 months from the date of receipt of this order. The date 04.02.2019 is cancelled and the petition is disposed of accordingly.
