BAIL APPLN. 784/2017 The petitioner seeks interim bail for appearing in 6th Semester B.A. (Pass Course & Vocational Course).
The exam is scheduled from 28.04.2017 to 15.05.2017.
It has been submitted on behalf of the petitioner that earlier also, the petitioner was permitted to appear in the examination by the order of this court.
On this occasion, the court below was inclined to release the petitioner on interim bail, but only in custody, to sit in the examination,
which was not acceptable to the petitioner.
Considering the fact that the petitioner had earlier been granted interim bail, without any fetter, for appearing in the examination, this court is inclined to release him to appear in the rest of the papers for the 6th semester.
Let the petitioner be released on interim bail till 16.05.2017 on his furnishing a bond in the sum of Rs.10,000/- with two sureties, one of whom would be his father, of like amount, to the satisfaction of the Trial Court. He shall furnish his and his surety's mobile telephone numbers to the SHO of the concerned police station so that in case of necessity he could be tracked and his whereabouts could be ascertained. The petitioner, during this period, shall positively go to the examination centre and take the examinations. Should the State learn that the petitioner has been misusing the privilege of bail by not writing his examination, it would be open to the State to seek cancellation of his interim bail. The petitioner, in the meantime, shall not indulge in any unlawful activity and shall restrict his moment to his home and examination centre as far as possible.
