% 09.05.2017 Learned counsel for the petitioner submits that the petitioner wants to withdraw the present petition with liberty to the petitioner to take the plea of alibi either before the Investigating Officer or before the concerned Trial Court at the appropriate stage.

In view of the submission made by counsel for the petitioner, the prayer is allowed and the present petition is dismissed as withdrawn and disposed of with liberty to the petitioner to raise the plea of alibi at the appropriate stage before the Trial Court concerned as per law.
