O R D E R

% 10.10.2017 The petitioner seeks bail in anticipation of his arrest in connection with FIR No.173/2015 dated 16.03.2015 (P.S.Timar Pur) instituted for the offence under Sections 120B/420/467/468 IPC.

The averments in the FIR reflect that one Vinod Kumar Mishra was duped by co accused Ranjeet Kumar and Kanhaiya Kumar of Rs.5 lakhs on the pretext of providing him a job of an Assistant in the Food Corporation of India. For the aforesaid purpose, the complainant had paid Rs.5 lakhs to the aforesaid co accused persons namely Ranjeet Kumar and Kanhaiya Kumar. Out of the aforesaid Rs.5 lakhs, investigations revealed, some amount was transmitted in the name of father of the petitioner in the district of Rohtas in the State of Bihar. The investigations have also revealed that Kanhaiya Kumar had tried to return the money to the complainant but the cheque which was given by him bounced.

During the course of investigations, Ranjeet Kumar and Kanhaiya Kumar were arrested.

The petitioner had approached this Court for grant of anticipatory bail on the ground that he was not even aware of the lodging of the FIR and has been made accused in this case only because he happens to be the brother of the two other accused persons who were arrested. It has been submitted on behalf of the petitioner that all the accused persons have been granted bail except him.

Dr.M.P.Singh, learned APP has submitted that the charge sheet has now been submitted. The petitioner after getting interim protection by this Court by order dated 05.09.2016 had participated in the investigation. Considering the aforesaid facts, this Court is inclined to confirm the provisional anticipatory bail granted to the petitioner. The petitioner is directed to be released on bail, in the event of his arrest or surrender, on his furnishing a bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Arresting Officer/Court.

The application is disposed of.
