TR.P.(C.) 157/2018 The petition is prima facie premised on the delay in disposal of the proceedings in RCT 27/16 pending before the Rent Control Tribunal (West), Tis Hazari, Delhi submitting that the said proceedings having since been transferred vide order dated 14.01.2016 from the Rent Control Tribunal (Central), Tis Hazari, Delhi on CM(M) 535/2015 having been filed by the very same petitioner seeking an expeditious disposal of the said proceedings in relation to the eviction petition having been allowed on 21.02.2007. As per the record of the present proceedings vide order dated TR.P.(C.) 157/2018
25.09.2017 of this Court also the Rent Control Tribunal (West) was requested to hear the appeal on 02.11.2017 and to ensure disposal thereof before the end of the year 2017. Apparently there is no incumbent in the post of the Rent Control Tribunal (West) w.e.f. 01.11.2017 on retirement of the previous incumbent. Taking the said aspect into account and also the factum that the suit premises in question is situated within the Central District, the proceedings of RCT 27/16 pending before the Rent Control Tribunal (West) are withdrawn and assigned to the learned District and Sessions Judge (HQ), Delhi with the directions that the proceedings of RCT 27/16 pending before the Rent Control Tribunal (West) be placed before the Rent Control Tribunal (Central) on 08.10.2018 at 2.30 p.m. where the parties are directed to appear with the request to Rent Control Tribunal (Central) to take up the matter expeditiously.
Copy of this order be served on the respondent and to the Learned counsel for the respondent by the Registry.
Copy of the order be given dasti, as prayed.
