versus KHUB CHAND ..... Respondent Through:

Mr. Atul Kumar Sharma, Advocate.

CORAM: JUSTICE S.MURALIDHAR

% 26.10.2016

1. This petition is pending in this Court for more than one and a half years and till date no steps have been taken by the Petitioner to have the Arbitrator appointed. It is stated that the application filed by the Petitioner in the suit filed by the Respondent seeking reference of the disputes to arbitration was allowed by the Civil Court but the Respondent has carried the said order in appeal. Apparently, there is no stay of that order.

2. The interim order passed by this Court on 26th may 2015 is directed to continue for a period of eight weeks within which the Petitioner should take steps to appoint the Arbitrator. It is made clear that if no steps are taken by the Petitioner within the time granted, the interim order shall automatically stand vacated.

3. The petition is disposed of.
