% 20.08.2018 Lifecare Innovations Pvt. Ltd. has filed the present writ petition impugning modification order dated 28th May, 2018, issued by the Government of NCT of Delhi in respect of notice inviting tender vide notification/order No.18_01 dated 18th July, 2018. The challenge is confined and restricted to quotations submitted by the petitioner in respect of Amphotericin B-Lipsomal 50mg/vial Inj 1 vial. Learned Standing Counsel for the Government of NCT of Delhi, who is present on advance notice, states that Tender No.18_01 dated 18th July, 2018 in respect of the aforesaid drug is being recalled and, therefore, the grievance raised by the petitioner in the present writ petition does not survive.

We take the statement made by the Standing Counsel on record. Respondents would be bound by the statement.

Counsel for the petitioner in view of the statement made by the Standing Counsel seeks permission to withdraw the writ petition and states that, if aggrieved, by the action of the respondent and if advised, the petitioner may file a separate writ petition. Without comments and observations, the writ petition is dismissed as withdrawn with liberty as prayed for.
