This order is in continuation of the earlier order dated 17th August, 2018.

The senior counsel for the respondent No. 1 appears. 3.

The respondent No.1 has also filed CM No. 34604//2018 placing on record certain facts.

However, after some hearing, the senior counsel for the respondent No.1 fairly states that this petition be disposed of with a direction to the District Judge to hear the appeal under Section 9 of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 on 30th August, 2018, when it is listed for hearing, and to dispose of the same expeditiously and till the disposal of the appeal the respondent shall maintain status quo. The petition is disposed of making absolute the interim order dated 17th August, 2018 and requesting the Additional District Judge-04, NorthWest to hear the appeal under Section 9 of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 preferred by the respondent No.1 and listed on 30th August, 2018 on 30th August, 2018 itself and to dispose of the same within three days thereof.

The counsels states that they will participate in expeditious disposal of the appeal and shall not take any adjournments and carry their respective written submissions if any with them and make only brief oral submissions. 7.

It is further ordered that no observation in the order dated 17th August, 2018 or in this order shall influence the learned Additional District Judge in the decision of the appeal under Section 9 of the Public Premises (Eviction of Unauthorised Occupants) Act, 1971.
