% 15.07.2016 Crl.M.B. 801/2016 By this application the appellant had sought regular suspension of sentence on the ground of illness.

This Court had called for latest nominal roll and medical status report from Superintendent Jail.

Learned counsel for the appellant and learned APP for the State on the basis of report sent by Superintendent, Tihar Jail submits that the appellant Jaipal Singh was declared dead in Deen Dayal Hospital on 20th June, 2016 at 5.00 PM. The report is taken on record.

The application is accordingly dismissed as infructuous. Crl.A. 582/2015 Since the appellant has passed away, the appeal is disposed of as abated.
