Versus

STATE (GOVT OF NCT OF DELHI) & ORS.

..... Respondents Through:

Mr. Ashish Aggarwal, Additional Standing Counsel for State with ASI Chatar B., P.S.

Keshav Puram.

CORAM:

HON'BLE MR. JUSTICE NAJMI WAZIRI

O R D E R

% 02.11.2018 The petitioner's grievance is that his complaint about an assault on him and his father has not been duly looked into and the FIR lodged against the accused persons on the basis of the said complaint overlooks a number of aspects. In other words, a weak FIR has been registered by the police and the Investigating Officer has not taken any action against the persons mentioned therein.

According to the Status Report dated 30.10.2018, filed by the Station House Officer of Police Station Keshavpuram, Delhi, some investigations have been ensued on the basis of the MLC, which records that the complainant had suffered minor injuries.

Be that as it may, whether an injury is minor or grievous would not be a determining factor of the case and that the investigation apropos involvement of each person would be necessary insofar as there is an attempt to cause or otherwise breach of peace.

In the circumstances, the matter would be looked into by the DCP of the area concerned. The petitioner shall meet the DCP in the forenoon of 19.11.2018. After considering the matter, the DCP will issue appropriate directions as he may deem fit.

The petition stands disposed-off in the above terms. NAJMI WAZIRI, J.
