(E) (COMM.) 10/2017 This petition is filed under Section 27 of the Arbitration and Conciliation Act, 1996 for summoning of witnesses as stated in paragraph 3 of the petition to adduce evidence before the learned Sole Arbitrator on 18.05.2017. It is stated that a request to the same effect was also made before the learned arbitrator who agreed to the same vide its order dated 22.03.2017.

Witnesses No. 1 and 2 are described as Assistant Commissioner of Customs of the concerned stated Department. The said witnesses are only required to bring certain communications. Hence, the presence of the

Assistant Commissioner himself would obviously not be necessary. Accordingly, the concerned officials from the office of Assistant Commissioner of Customs as described in Serial Nos. 1 and 2 of the list of witnesses along with the official mentioned at serial No. 3 may be summoned for 18.05.2017 before the learned arbitrator at 10.30 AM. The petitioner to take steps to serve summons dasti. The petition stands disposed of.
