% 11.10.2017 I.A.No.11732/2017 Today learned counsel for the plaintiff has handed over an amended memo of parties. The same is taken on record. Learned counsel for the parties are also permitted to correct a typographical error in the Partition Settlement dated 26th September, 2017 after initialing the same.

Present joint application has been filed under Order 23 Rule 3 read with Section 151 CPC. The same is duly signed by learned counsel for the plaintiff and defendants as well as by the parties to the litigation.

Present application is also supported by affidavits of the plaintiff and the defendant no.1 and legal heir of the previous defendant no.2.

Learned counsel for all the parties state that the matter has been compromised in accordance with the terms mentioned in the Family Settlement and Partition Settlement both dated 26th September, 2017. The learned counsel further assure and undertake to this Court that the parties shall comply with the settlement terms mentioned in the present application as well as the said Family Settlement and Partition Settlement.

The aforesaid statements, assurances and undertakings given by learned counsel for the parties are accepted by this Court and parties are held bound by the same.

This Court has also perused the compromise application as well as the said Family Settlement and Partition Settlement and is of the opinion that they are lawful.

Consequently, the suit is decreed in accordance with the settlement terms mentioned in the present application as well as the Family Settlement and Partition Settlement, copies of which are marked as Ex. C-1. Registry is directed to prepare a decree sheet accordingly.

With the aforesaid observations, present application is allowed and the suit and pending application stand disposed of. The interim order dated 14th November, 2014 stands vacated. MANMOHAN, J OCTOBER 11, 2017 KA
