O R D E R

% 19.09.2017 In pursuance to the last order, Mr. Mohit Aggarwal, Authorised Representative of the plaintiff-company as well as defendant nos. 1 and 3 are personally present. The said defendants on behalf of defendant no. 2 as well as for themselves reiterate that they are willing to suffer a decree in terms of the prayer (A) of the paragraph 38 of the plaint. Learned counsel for the plaintiff on instruction of the Authorised Representative of the plaintiff-company states that the defendants must pay a small amount as token damages/compensation. After some arguments, it is agreed that a sum of Rs. 1,00,000/- shall be paid by the defendants to the plaintiff within one week.

Both learned counsel as well as the parties pray that the present suit be disposed of in terms thereof.

The statements, assurances and undertakings given by both the counsel are accepted by this Court and parties are held bound by the same. Consequently, present suit is decreed in accordance with prayer (A) of the paragraph 38 of the plaint and the defendants are directed to pay Rs. 1,00,000/- to the plaintiff within one week. Registry is directed to prepare a decree sheet in terms thereof.

Registry is also directed to issue to an authorised representative of the plaintiff a certificate authorizing him/her to receive back from the Collector full amount of the Court fee paid by it in the present suit. With the aforesaid directions, present suit and pending application stand disposed of.
