Learned counsel for the petitioners has submitted that an appeal has been preferred against the decision of Deepak Kumar and Ors. Vs. District and Sessions Judge, Delhi & Ors., 192 (2012) DLT 602 (FB) before the Supreme Court and has been listed before the Constitution Bench of Five Judges but there is no stay. The full Bench decision in Deepak Kumar and Ors. (Supra), is binding on us. Accordingly, this writ petition has to be dismissed. No costs.
