% 26.04.2018 The petitioner and the respondent company have settled the disputes. Today, in court the learned counsel for the respondent company has handed over to the learned counsel for the petitioner a banker cheque of Rs.53,620/- being balance amount/payment towards the full and final settlement of the claim of the petitioner.

The learned counsel for the petitioner submits that now he seeks to withdraw the present petition.

This court on 10.11.2017 had appointed the OL as the provisional liquidator. In the interest of justice, the said order dated 10.11.2017 appointing the OL as the provisional liquidator is recalled subject to payment of cost of Rs.25,000/- by the respondent company to the OL within three weeks from today.

The present petition is dismissed as withdrawn. All the pending applications, if any, is also dismissed as withdrawn. JAYANT NATH, J.
