% 08.11.2017 I.A. 13093/2017 Present suit has been fled for permanent injunction restraining the defendant No.1 from encashing the Bank Guarantee dated 09th April, 2015. On 11th September, 2017, upon an application being filed by the plaintiff, the Secretary Ministry of Commerce, was directed to consider the application of the plaintiff within a period of four weeks. Today, plaintiff has filed an application being I.A. 13093/2017 for withdrawal of the suit.

In the said application, it has been averred that in view of the order

dated 11th September, 2017 passed by this Court, a meeting was held on 24th October, 2017 under the Chairmanship of Shri Sunil Kumar, Additional Secretary, Ministry of Commerce and Industries, to discuss the matter relating to the dispute between the parties.

It is further averred that the said meeting was attended by the representatives of the parties wherein it was resolved that all the disputes between the parties shall be settled amicably and the present suit pending before this Court be withdrawn.

Consequently, the present application is allowed and the present suit and pending applications are dismissed as withdrawn. Registry is directed to issue to an authorised representative of the plaintiff a certificate authorizing him/her to receive back from the Collector half amount of the Court fee paid by it in the present suit.
