% 02.12.2016 EA (OS) 1169/2015 The decree, execution of which is sought through the execution petition at hand was passed ex parte. It is pointed out by the judgment debtor / respondent that his application under Order 9 Rule 13 CPC is pending which on account of change of the pecuniary jurisdiction has since been transferred to the District Courts. It is submitted that the said matter is now pending on the file of Mr. Balwant Rai Bansal, Additional District Judge, South East, Saket District Court with next date of hearing fixed as 19.12.2016.

The learned counsel for the execution petitioner / decree holder submits that the execution petition may also be transferred to the court of Additional District Judge so that the same with the matter arising out of the application under Order 9 Rule 13 CPC can proceed together. The execution petition is transferred to the court of Mr. Balwant Rai EX.P. 427/2014

Bansal, Additional District Judge, South-east, Saket District Court. The parties shall appear before the transferee court on 19.12.2016. The Registry to send the file well in time.
