% 05.09.2016 By the present petition the petitioner seeks anticipatory bail in case FIR No.315/2016 under Sections 308/452/506/34 IPC registered at PS Kirti Nagar on the complaint of the injured Pankaj Kapoor. Notice. Learned APP for the State accepts notice. The allegations in the FIR by the complainant are that on 20th August, 2016 at about 2 O'clock in the afternoon when he along with his wife and children was going to his house on a vehicle the petitioner had parked his vehicle in the middle of the road. Despite the complainant asking to remove the vehicle the same was not removed and a quarrel took place. The petitioner tried to manhandle the complainant, however the complainant left BAIL APPLN. 1799/2016
the spot. Later at 3.30 PM on the same day while the complainant was sitting in his shop the petitioner along with his son entered the shop, abused and caught hold of the collar of the complainant when the son of the petitioner slapped and injured the complainant by hitting with a steel bucket lying on the counter on his head.
I have perused the MLC of the complainant which notes two contused lacerated wound over the left parital region. The son of the petitioner who had inflicted the injury has already been arrested and granted regular bail. Considering the role assigned to the petitioner and the fact that he has joined the investigation, I deem it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of 25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned.
Petition is disposed of. Order dasti.
