At the outset, I pointed out that the petitioner is a member of my staff and the petition may be transferred to another Court. However, Mr. Rajesh Gogna, the learned counsel appearing for the respondents states, on instructions, that the petitioner would be at liberty to bid afresh. He further states that his Registration Number (10045527) shall remain the same and he shall retain his position of seniority as obtained at the time when he applied for the flat at Lodhi Road Complex.

Obviously, the flat allotted to the petitioner cannot be allotted to him since it has been considered as unsafe and is not available for allotment to any person.

In view of the statement made by Mr. Gogna, the petitioner would be at liberty to bid afresh and no further orders are required to be passed in the present petition.

In the event the petitioner has any issues, the petitioner is also at liberty to approach the concerned officer of the respondent for clarification. 7.
The petition is accordingly disposed of. The pending application is also disposed of.
