1. A settlement agreement ('SA') dated 28th April 2016 signed by the parties has been placed on record. The parties are bound by the SA. It is stated that in terms of the SA payments have been made by the Defendant to the Plaintiff which is acknowledged by learned counsel for the Plaintiff.

2. As jointly prayed for, the suit is decreed in terms of the SA.

3. Since the settlement has been arrived at pursuant to the mediation, upon a reference by the Court, the Plaintiff is entitled to refund of the entire court fees paid on the plaint under Section 16 of the Court Fees Act, 1870.

4. The Registry will prepare, and issue to the Plaintiff, within two weeks CS (OS) 1221/2015

from today, a certificate entitling the Plaintiff to receive back from the Collector of Stamps the full amount of the court fees paid by the Plaintiff on the plaint.

5. The applications are disposed of.
