% 22.10.2019 This is an application for grant of anticipatory bail filed by the applicant/petitioner under Section 438 of Code of Criminal Procedure, 1973. Learned counsel for the petitioner prays for bail to the petitioner on the ground that the petitioner is suffering from chronic diabetes and the same has affected his eyes. The petitioner is presently undergoing treatment of detachment of retina. Learned counsel for the petitioner further submits that he has already been paying the maintenance as ordered by the Metropolitan Magistrate and he undertakes to pay future school fee of the child, without fail.
Learned APP for the State and Ld. Counsel for the complainant have no objection if the bail is granted to the applicant.
Keeping in view the aforesaid facts and circumstances, the applicant/petitioner is admitted to bail on his furnishing a personal bond in the sum of Rs.15,000/- with one surety in the like amount to the satisfaction of Investigating Officer/Station House officer. The bail application stands disposed of.
