O R D E R

% 29.05.2017 Learned counsel for the petitioner submits that the petitioner on his own risk will examine Anil Aggarwal as the Defence Witness on the next date of hearing and that he will not ask for another date before the Trial Court or ask for summoning of the said witness before the Trial Court and that he will not seek any extention of dates before the Trial Court and prays that the petition be allowed.

Learned counsel for the respondent No.2 agreed to such proposal of learned counsel for the petitioner.

In view of the submission of learned counsel for the petitioner, the summoning of Anil Aggarwal is not required and the petitioner is directed to examine Anil Aggarwal as a defence witness on 3rd July, 2017 at his own risk. The petition is allowed to the extent of examination of Anil Aggarwal

and disposed of accordingly.

A copy of this order be sent to the concerned Trial Court forthwith. Copy of this order be given dasti to the parties, as prayed. I.S.MEHTA, J MAY 29, 2017/km
