% 05.12.2018 Respondent no. 3 is Authorised Representative of respondent no.2. It is submitted that matter has been settled between the petitioner and respondent no.2, therefore, FIR No. 230/2013 under Sections 408/420/120B IPC registered at police station Vivek Vihar may be quashed. Respondent no.2 is present in Court and has been identified by SI Sanjeev Kumar of police station Vivek Vihar. He submits that matter has indeed been settled between the petitioner and respondent no.2 vide Memorandum of Understanding/Settlement Deed dated 15.03.2018 voluntarily and without any undue force, pressure or coercion. He further submits that `5.25 lacs stands paid by the petitioners to the respondent no.2 and respondent no.2 has no objection in case FIR is quashed. Respondent no. 3 has identified his

signatures on the MOU/Settlement Agreement at point X. Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
