CM APPL. 1465/2024 1.

Present is an application under Section 151 of Code of Civil Procedure, 1908 ("CPC") on behalf of respondent no.3/University Grants th Commission ("UGC") for recall of the order dated 13 September, 2017 by which the present contempt petition had been adjourned sine die. 2.

The present petition had been filed on behalf of the petitioner seeking initiation of contempt proceedings alleging non-compliance of the order th August, 2016 passed by the Division Bench of this Court in LPA dated 24 No. 410/2014. The said judgment was challenged before the Supreme Court. th 3.

It is submitted that UGC has complied with the Judgment dated 10 May, 2022 passed by the Supreme Court in SLP(C) No. 13901/2017. 4.

It is submitted that the Supreme Court by its common Judgment dated th May, 2022 has finally decided the issues for the batch of petitions. The petitioner herein was working in Shyama Prasad Mukherjee College, University of Delhi.

has brought forth that the University of Delhi vide its letter dated 17th March, 2023 had informed about the pension beneficiaries from 9 colleges who had filed contempt petitions before this Court.

It is also submitted that the UGC had disbursed the requisite amounts to the respective colleges for disbursal of amounts towards pension dues of the various beneficiaries. Thus, it is submitted that petitioner has already been released an amount of Rs. 33,32,302/-. It is further submitted that the UGC had already released all the amounts for payment of CPF/GPF to the various th beneficiaries. Therefore, it is submitted that judgment dated 10 May, 2022 passed by the Supreme Court has been complied with. Thus, it is submitted that no further order is required to be passed in the present petition. rd 7.

Attention of this Court has also been drawn to the order dated 23 November, 2023 passed in CONT.CAS(C) 128/2017, wherein similar orders have been passed by recording that the compliance has been made. 8.

Considering the aforesaid submission, the present application is allowed and is accordingly disposed of.

In view of the submissions as recorded in CM APPL. 1465/2024, the present contempt petition is disposed of as satisfied.
