% 10.09.2015 I.A. No. 18823/2015 (u/O 23 R 3 CPC) Original settlement deed dated 3rd September, 2015 has been placed on record photocopy whereof, has already been annexed with the present application.

It is submitted that parties have settled their disputes on the terms and conditions as stipulated in the settlement agreement. Settlement agreement has been signed by the parties. Ms. Shiffali Wadhawan, Attorney of plaintiff is present in Court so is defendant. Both of them admit having signed the settlement deed dated 3rd September, 2015. Settlement agreement is marked as Mark 'C-1'.

I do not find terms of settlement to be in

conflict with any law. Parties shall remain bound by the terms of settlement. Accordingly, a decree is passed in terms of Mark 'C-1', which shall form part of the decree. Date fixed in the matter, that is, 19th October, 2015 is hereby cancelled.

Since parties have settled their disputes before framing of issues, let 50% of the court fee be refunded to the plaintiff and necessary certificate in this regard be issued by the Registry.
