% 05.09.2016 Learned counsel for the State seeks and is granted permission to place on record status report.

As per the said status report, Rohit Kumar s/o Jaipal Singh (the petitioner) was arrested on 31st August, 2016 at about 7 P.M. and was thereafter produced in the court of the learned Metropolitan Magistrate, Mr. Rakesh Kumar Singh on 1st September, 2016 and sent to judicial custody for one day. Thereafter on 2nd September, 2016, he was sent to judicial custody

for fourteen days.

It is stated that Rohit Kumar is involved in FIR No. 2209/2015 under Sections 394/397/411/34 of the Indian Penal Code registered at Police Station Shakarpur. He was declared a Proclaimed Offender vide order dated 28th July, 2016 as he could not be arrested in spite of non-bailable warrants issued to him earlier. Rohit Kumar had earlier applied for grant of anticipatory bail, which prayer was rejected by the Sessions Court vide order dated 26th April, 2016. Thereafter, Rohit Kumar had filed an application seeking anticipatory bail before the High Court, which was dismissed in default. Keeping in view the aforesaid facts, and probably the fact that the petitioner was aware of the full facts but has not disclosed the factum, we are not inclined to pass any further orders in this writ petition. Learned counsel for the petitioner submits that a prayer has been made for transfer of investigation to CBI. We clarify that we have not expressed any opinion on the said aspect. The writ petition is accordingly disposed of. SANJIV KHANNA, J.
