Bail Appln. 788/2017 This is an application filed on behalf of petitioner under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No. 112/2017, under Sections 325/380/448/452/34 IPC, registered at Police Station Pandav Nagar.
Learned counsel for the petitioner has submitted that the petitioner is apprehending her arrest from Police Station Pandav Nagar in the aforementioned FIR. He further submits that the petitioner is an old lady and the dispute is between the brother and sister and that nothing is to be recovered at the instance of the petitioner, as the main accused persons have already been arrested. He further submits that there is no evidence qua
against the present petitioner. He also submits that the petitioner is also ready to join the investigation and accordingly prays that the petitioner be released on anticipatory bail.
Learned APP for the State, on the other hand, vehemently opposes the anticipatory bail application. She, on instructions of IO, however submits that nothing is to be recovered at the instance of the present petitioner. Keeping in view the facts and circumstances, the petitioner is directed to join the investigation and in the event of her arrest, she be released on anticipatory bail on furnishing bail bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of IO/SHO concerned, with the further condition that she shall not leave the Country without prior permission of the Court and shall not tamper the prosecution evidence. The present bail application is allowed and disposed of accordingly. Copy of this order be given dasti.
