O R D E R

% 03.05.2017 The present petition is filed under Section 14 of the Arbitration and Conciliation Act, 1996 seeking termination of the mandate and substitution of the Arbitrator-Ms. Mamta Sehgal (Retd.), District and Sessions Judge. The petitioner had earlier filed an Arbitration Application being A.A. 316/2008 for appointment of an Arbitrator which was disposed of by this court vide order dated 17.09.2009 by appointing Ms. Mamta Sehgal, District and Sessions Judge (Retd.) as a sole Arbitrator to adjudicate the disputes between the parties.

Ms. Mamta Sehgal has written to the Registrar General of this court stating her inability to continue as an Arbitrator. Learned counsel for the parties agree that a new arbitrator may be appointed.

Accordingly, Mr.Amar Nath, District Judge (Retd.) (Mobile

No.9958697030) is appointed as an Arbitrator in lieu of Ms. Mamta Sehgal (Retd.), District and Sessions Judge. The learned Arbitrator now appointed shall adjudicate the disputes from the stage at which they were pending before the previous learned Arbitrator. The learned Arbitrator shall decide his fee in consultation with the learned counsel for the parties. The appointment of the Arbitrator is subject to compliance of Section 12 of the Arbitration and Conciliation Act, 1996. Arbitral record may be sent to the newly appointed learned Arbitrator.

In view of the above, the present petition stands disposed of. The parties to appear before the learned Arbitrator on 25.05.2017 at 4.00 PM.
