O R D E R

% 13.11.2017 In pursuance to the last order, Mr. Sidhartha Kishore Das, General Manager of defendant-company is personally present. Learned counsel for the defendant on instruction of the aforesaid authorised representative states that the defendant has no objection if the present suit is decreed in accordance with the prayer (A) of the present plaint. He further states that the defendant shall make payment of Rs.75,00,000/- to the plaintiff within a period of one week by way of an account payee cheque.

In view of the aforesaid statement, learned counsel for the plaintiff does not wish to press for any other relief.

The statements/undertakings given by the both counsel are accepted by this Court and the parties are held bound by the same. Consequently, present suit is decreed in accordance with prayer (A) of the plaint as well as the aforesaid statement/undertaking given by the learned counsel for the defendant. Registry is directed to prepare a decree sheet accordingly. Registry is also directed to retain a certified copy of the original documents filed by the plaintiff and thereafter return the same to it. With the aforesaid observations, present suit and pending applications stand disposed of.
