BAIL APPLN. 1895/2016 Issue notice. Notice is accepted on behalf of the State. The petitioner has preferred the present application to seek regular bail. The petitioner is one of the accused in case FIR No.412/2012 registered under section 363/373/344/120B IPC and Section 5G POSCO Act and Section 3/4/5/6 of ITP Act. The petitioner is in judicial custody since 09.08.2013. The trial is in progress. The prosecutrix has been examined and cross examined, and

some part of her cross examination by one of the counsels for one of the accused is still incomplete. The prosecutrix in her testimony has deposed about the role of the applicant thereby implicating the applicant. The prosecutrix has, inter alia, deposed that she was taken to a brothel at Silligudi which belong to the petitioner. The petitioner paid money to Mona, who had taken the prosecutrix to the petitioner's brothel. She further stated that the brothel was visited by several customers and she was made to indulge in sex with them. She has further stated that the petitioner used to threaten her by stating that she had purchased her for Rs.8 lacs from Mona. The misery of the prosecutrix continued for about one and half months at the brothel of the petitioner.

Looking to the seriousness of the charge and the evidence which has come on record on the examination of the prosecutrix, I am not inclined to grant bail to the petitioner at this stage. Dismissed. VIPIN SANGHI, J SEPTEMBER 19, 2016 sr
