Admittedly the first application for anticipatory bail filed by the petitioner before this Court was dismissed as withdrawn on 4th April, 2018. 2.
Learned counsel for the petitioner submits that the said application was withdrawn because the Court was not inclined to grant the anticipatory bail for the reason the injury was opined to be grievous in nature. 3.
Pursuant to a PCR call dated 3rd August, 2016, FIR No.398/2016 was registered for offences punishable under Sections 323/341/34 IPC at PS Seelampur on the complaint of Mushtak, father of the petitioner and since BAIL APPLN. 2009/2018
the offences were bailable, bail was granted. However subsequently final opinion on the injury of Tahir the injured was received which was opined to be grievous in nature hence Sections 308/326 IPC were added to the investigation. Since all these facts were duly before this Court and there are no new facts, petition is dismissed.
