CORAM:

HON'BLE MR. JUSTICE I.S.MEHTA

% 16.05.2017 This is an application under Section 438 Cr.P.C. filed on behalf of the petitioner for grant of anticipatory bail to the petitioner in case FIR No.0058/2017, under Section 408 IPC, registered at Police Station-Okhla Industrial Area.

Learned counsel for the petitioner has submitted that the petitioner was working with the complainant company as an Accounts Manager. He further submits that the petitioner is apprehending his arrest in the said FIR. He further submits that the petitioner is ready to join the investigation and submits that the petitioner has not taken any of the amount and all the allegations are false and prays that the petitioner be released on anticipatory bail.

Learned APP for the State, on the other hand, vehemently opposes the

anticipatory bail application, while submitting that the petitioner was the Accounts Manager of the complainant company namely Insat Equipments India Pvt. Ltd. having its office at A-42, FIEE Complex, Okhla Industrial Area, New Delhi. She further submits that when the suspicion has arisen of the petitioner's involvement in embezzlement of amount of Rs.72 Lakhs, the petitioner has run away and his anticipatory bail application has already been dismissed by the Trial Court and further the petitioner has failed to join the investigation till date. She further submits that the petitioner is required for custodial investigation and prays that the anticipatory bail application be dismissed.

Since the petitioner is required for custodial investigation, I do not find it a fit case for grant anticipatory bail to the petitioner. Consequently the present bail application is dismissed.

The present petition is disposed of accordingly. Copy of this order be given dasti, as prayed. I.S.MEHTA, J MAY 16, 2017/km
