% 07.09.2016 Crl.M.A. No. 13914/2016 Exemption allowed, subject to all just exceptions. The application stands disposed of.

W.P.(CRL) 2611/2016 and Crl.M.A. No. 13913/2016 Issue notice. Mr. Kundu accepts notice on behalf of the State. Notice is also accepted by respondents No.2 to 6, who are personally present in Court.

This petition has been preferred by the petitioner to seek quashing of FIR No.535/2016 under Section 363 IPC registered at Police Station - Malviya Nagar.

Mr. Kundu, on instructions, submits that he does not oppose the petition since the State has also decided to file for cancellation of the bail. Respondents No.2 to 6, who are personally present and are identified by the Investigating Officer, also state that they are agreeable to the FIR being quashed and that they do not wish to pursue this FIR any further. They state that no threat or coercion has been exercised on them to make their statement.

Accordingly, the FIR No.535/2016 and the proceedings emanating therefrom stand quashed.
