% 23.02.2016 In view of notification no 27187/DHC/Orgl. Dated 24.11.2015 & in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), which came into force with effect from 26.10.2015 vide Notification No. F. No. L-19015/04/2012-Jus dated 26.10.2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs, published in Gazette of India Extraordinary, Part-II, Section 3 Sub Section (ii), the present matter stands transferred to the jurisdictional subordinate courts.
Learned counsel for the plaintiff has sincere his apologised for non-taking the steps for the service of the defendants. Though one of the defendant is stated to be in the judicial custody and two defendants are absconding from facing the trial from the criminal Court .
Learned counsel for the defendant No.4 seeks time to file written statement.
As such, defendant No.4 be directed to file written statement in accordance with law with advance copy to the other side followed by replication within two weeks thereafter.
Plaintiff be directed to take fresh steps for the service of defendants 1 to 3 as directed in the previous order. Steps be taken within two weeks time.
Apart from this, learned counsel for the plaintiff further submits that the valuation of the suit property for the purpose of pecuniary jurisdiction is less than two crores and addresses of the defendants 1 & 2 are within the jurisdiction of South-East District as such requests to send the matter to the Ld District & Session Judge (South-East District), Saket Court.
Hence, in view of the submission and circumstances, the matter be sent to the Ld District & Session Judge, (South-East District) Saket Court.
Parties be directed to appear before the Court of Ld District & Session Judge (South-East District), Saket Court on 29.07.2016. The suit files be made available to the Ld District & Session Judge (South-East District) at Saket Court on the date fixed. DR.
