Learned counsel for the petitioner submits that this petition can be disposed of as the alternate prayer made by the petitioner is that his application seeking allotment of an alternate plot should be decided as per seniority. This court notes this submission of the petitioner. This court also notes that in spite of opportunity having been granted to the respondents to file their counter affidavit the same has not yet been filed. The prayer made in the petition is allowed. The case of the petitioner be processed and if any application of the petitioner is pending before the department seeking allotment of the alternate plot, the same shall be decided in accordance with law and as per seniority. Petition disposed of.
