O R D E R

The appeal impugns a money decree dated 12th March, 2015 of the Court of Additional District Judge (South), Saket Courts, New Delhi in CS No.409/2014 bearing Unique I.D. No.02406C0347082014 consequent to dismissal of application for condonation of delay in entering appearance to contest a summary suit.

Notice of the appeal was issued and the parties referred to Mediation Centre, Saket Courts, New Delhi.

A Settlement Agreement dated 29th February, 2016 signed by the parties as well as by Sh. Anubhav Shangle, Mediator is received. 4.

Both counsels support the Settlement Agreement. 5.

The settlement arrived at between the parties is found to be lawful and is allowed.

The decree under appeal is modified in terms of the Settlement Agreement which shall form part of the decree sheet and the appeal is disposed of leaving the parties to bear their own costs. Decree sheet be drawn up.

The counsels state that the appellant present in person has today paid a sum of Rs.1,50,000/- in cash to the respondent also present in person. The counsels further state that the instalments in terms of the Settlement Agreement shall be paid before the Court before which Section 138 of the Negotiable Instruments Act, 1881 proceedings are pending.
